In cases where a company is contracted to develop a Bluetooth® enabled product for a client company (and only that client company), the contracted company is not required to qualify. The client company is responsible for completing the qualification.
If a company is contracted to develop a Bluetooth enabled product for a client company and then sells that design to other companies in addition to their original client, the contracted company is required to qualify the product, as well as any companies that purchase and re-brand said product (white labeling).
Examples:
Scenario 1 (Contracted Development): Company A is contracted by Company B to develop a Bluetooth enabled product to be sold only under Company B's brand.
Who must qualify?: Company B
Scenario 2 (White labeling): Company A develops a Bluetooth enabled product that is sold to Company B and Company C to be sold under Company B's brand and Company C's brand.
Who must qualify?: Company A, Company B, Company C
